Description: The Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 (Dodd-Frank Act) established the consumer bureau. Many of the pieces of the Dodd-Frank Act relating to the CFPB went into effect on July 21, 2011.
The bureau has unprecedented rule-making authority affecting all aspects of the financial and debt collection communities. There is a threat of incredible, intrusive, burdensome and costly regulation. What will the industry do? How will it react to these changes? Will smaller players survive or be forced out? This is the dawning of a new era in government supervision of all financial entities. Bob Belair discusses the new CFPB organization and the impact to our world.
About Bob Belair:
Robert R. Belair is currently a privacy attorney for Arnall Golden Gregory LLP at their Washington DC office.
Mr. Belair is a founding partner of Oldaker, Belair & Wittie in Washington and served for many years as co-editor of the nation's pre-eminent privacy periodical for the business community, Privacy & American Business. Prior to that, Mr. Belair was a long-time partner in the Washington DC office of what is now K&L Gates. Mr. Belair served as Deputy Counsel to the White House Privacy Committee in the Ford Administration and as a lawyer in the Federal Trade Commission's Bureau of Consumer Protection, doing privacy related work. He later served as General Counsel of the National Commission on the Confidentiality of Health Records. Mr. Belair also served on the Senate Judiciary Committee Advisory Committee for then Chairman Joseph R. Biden, and as an adviser to Senator Robert F. Bennett's Health Privacy Task Force.
Mr. Belair's privacy practice centers on the representation of privacy sensitive organizations with respect to credit and financial records, debt records, educational records, criminal records, medical records, employment records and telecommunications information. He has served as General Counsel to SEARCH, the National Consortium for Justice Information and Statistics and General Counsel to the National Commission on the Confidentiality of Health Records. He has also been chairman of an American Bar Association Privacy Committee. Mr. Belair also serves as Legislative Counsel to the DBA International. Mr. Belair has spoken and written widely on privacy and information law topics.

Mr. Belair's practice includes representation of clients before the courts, federal agencies, in particular, the Federal Trade Commission and the Congress. He has litigated numerous privacy and freedom of information cases, including serving as lead amicus counsel in the Supreme Court's 1989 landmark privacy and freedom of information and privacy decision, Reporters Committee for Freedom of the Press v. Department of Justice.
Mr. Belair has served as a legal consultant on privacy, freedom of information and information policy matters to numerous government agencies and commissions including the National Conference of Commissioners on Uniform State Laws, the National Academy of Sciences, the Office of Technology Assessment, the National Telecommunications and Information Administration, the Social Security Administration, the Department of Defense, the National Science Foundation, and the Federal Paperwork Commission. On the Hill, Mr. Belair has served on the Senate Judiciary Advisory Committee and the Senate Task Force on health privacy.
Mr. Belair received his law degree from Columbia University in 1973 where he was a Harlan Fiske Stone Scholar, a Charles Evans Hughes Scholar and Editor-in-Chief of the Columbia Human Rights Law Review.

Description: BMW Bank has recently implemented a flexible scorecard that allows the bank to more closely monitor and compare agency performance. This can be adapted to any portfolio or credit grantor's needs to help determine when an agency's performance is really declining and even to recommend remedial actions such as changing an agency's share of the portfolio and when to change to a new agency. Most importantly, it can be used to strengthen the partnership between credit grantor and collection agency so there are no crossed signals between them and results can improve significantly.

In this role he led a line of business that provided collections, recoveries, and fraud management for the bank's $187 billion portfolio of consumer lending products, plus ATM and debit cards, with responsibility for over 5000 associates. He was a member of the Bank's Management Operating Committee, Corporate Diversity Advisory Council and Corporate Workplace Steering Committee, and was a member of the Board of Directors for their credit card legal entity. In 2005, his line of business was recognized in the collections and credit risk trade publication as an industry leader. Previously, Robert was one of ten senior executives responsible for the spin off/start up of Capital One Financial Corporation, and held various leadership roles throughout Citicorp Credit Card Services during his 10 years with them.

Sterling offers its own credit programs and services its own receivables. Paula began her career as a credit management trainee for Sears. After learning the fundamentals of extending and collecting credit, she supervised a collection division that was one of the best in the corporation. She also taught inexperienced employees in all departmental positions and presented corporate training programs to all credit employees. As Executive Vice President for A.M. Miller & Associates, Inc., a large national collection agency located in Minneapolis, Paula was responsible for collections, as well as all collection area training and auditing. Under her leadership, the collection areas became top-performers for many national credit card, commercial, and student loan clients. Additionally, she implemented an internal audit program and developed management training modules as well as a management-trainee program.
With partners, Paula started a corporation called Collection Management Network (CMN) and served as its President and CEO. CMN operated a national network of collection agencies using a proprietary internet-based collection system. CMN also offered consulting and training services through its subsidiary, LPR.

John was Chief Operating Officer and Advisor at Tracmail India. Tracmail is an offshore outsourcing company (BPO) headquartered in Mumbai, India. John managed over 1,000 collection and customer service representatives in two sites and coordinated outsourcing operations with a number of clients in the United States and Canada.
In his most recent position John was Executive Vice President of Collection and Recovery at BBVA Compass. In that position John was responsible for directing all Collection & Recovery operations for all of the Retail Lending, DDA, and Small Business products. Mr. Lavery started his AAFES career in 1990 in the Office of the General Counsel working contract issues. He then litigated employment law cases. In 2005 he was promoted to Deputy General Counsel for the General Law and Revenue Recovery Division. Mr. Lavery advises on all federal debt collection statutes and regulations for AAFES' debt collection on over 1.8 million private label credit card accounts. He also manages AAFES' Bankruptcy program with over 60 million dollars in bankruptcy filed against AAFES annually.

After graduating with honors from UCLA, Mr. Winn attended Southwestern University of Law and received his Juris Doctor degree in 1977. He opened his own practice in 1982 specializing exclusively in creditor's rights. In 1991, he formed Winn and Sims, A Professional Corporation. The firm has six full time and one part time attorney plus a support staff of more than 100. The law firm subsequently changed it's name to the Winn Law Group, A Professional Corporation.
Mr. Winn is a member of the California Bar Association, all four California Federal District Courts, the United States Court of Appeals, several bankruptcy attorney forums and local bar associations. He served as Judge Pro Tem for the Los Angeles Superior Court and Municipal Courts for a number of years.
